The court ruled this week

"Ideas and general literary themes themselves are unprotectible under the copyright law," the judge said.

The case was copyright infringement of Dale Brown vs. Perdue concerning the Da Vinci Code. Perdue had written a similarily themed book and said Brown infringed upon the theme for Da Vinci Code.

I don't think that's a new ruling regarding copyright law, is it? New case, but same ol' ruling?

this was a major case, the ruling came yesterday. It involved not only two "A" list authors but also Random House and another major publisher.

the importance of the case to us little guys is that we don't have to fear about losing our work if some major person with money has something similar.

Comedians regularly steal each others material. To a lesser degree, writers have also done so since time immemorial. As long as you don't copy something verbatim, you are likely to get away with it.

That two people could come up with the same concept at virtually the same time is not unheard of. It happens all the time in science and technology.
