A group of comics is suing the author and publisher of joke books. The comics say the author collected the jokes by recording from TV or their stand-up routines.
If I sing Silent Night, record it and sell it on Amazon have I violated the copyright of the writer of the song. But then, if the writer of the song did not copyright the song?????? or the comics the jokes?????

The short answer is "yes". The Copright Office has a Form SR, similar to the Form TX, to be submitted with a recording of the music or speech. Those who have produced voice recordings of their books, or poems, or whatever, have probably availed themselves of that protection. I have.

But if you have not signed a form - is PUBLIC speech copyrighted?

I think Silent Night may be in the public domain, by the way. The original was written in 1818, with additional stanzas in 1864, according to our hymnal...

Perry, you have copyright protection whether or not you file it with the copyright office. There are more protections if you file, but the basic rule is that you are protected as soon as you put it on papr. Silent Night? Todd is correct. It is in the public domain. However, a particular arrangement or performance can by protected by copyright.
